Football Fan respects copyright law. If you believe that anything on Football Fan infringes your copyrights, you may submit to us a notification pursuant to applicable law so that we can solve it as soon as possible. Do not use this procedure for matters unrelated to copyright infringement.

Any content, trademark(s), or other material that may be found on the Football Fan App that is not Football Fan’s property remains the copyright of its respective owner(s). Please read this User Agreement fully and carefully before using Football Fan mobile application (the "APP") and the services, features or content or applications offered by Football Fan ("we", "us" or "our") (together with the APP, the "Services"). This User Agreement is the legally binding terms and conditions for the Services.
Football Fan is only for individuals whose age is 12 years and above. If we acquire knowledge, that anyone under the agreed age of consent is using our service, his or her account will be terminated with immediate effect.

We do not endorse, verify or vouch for and are not responsible for any view expressed, or the content, products or services on or available from those APP users, websites, advertising, or resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from, your use of any APP users’ content, third-party websites, advertising, or resources.
We and our licensers exclusively own all right, title and interest in and to the Services. All rights to the Content, News Content and Advertising Content are retained by the third-party that is the source of such Content. You acknowledge that the Services and Content are protected by copyright, trademark in accordance with applicable law. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Services or Content.
This agreement does not authorize you to, and you may not, copy, distribute, transfer, modify, publicly display, publicly perform or create derivative works based upon Content without our or the third-party’s permission.

You acknowledge and agree that as most of internet software and Services, the Software or the Services may be under the influence of various factors including but not limited to reasons from the user, quality of the internet service and social environment, and may also be subject to various security problems including but not limited to actual disturbance in case of illegal use of user information as well as threatened insecurity of your terminal device information and data due to possible presence of viruses, Trojans or other malwares in other software downloaded by the user or other websites visited by the user, which in turn affect the normal use of the Software or the Services. Therefore, you should have higher awareness of information safety and protection for personal information and pay attention to protecting your passwords to avoid losses.
The Information, software, Products and services, included in or available through the App may include inaccuracies or typographical errors. Football Fan assumes no liability or responsibility for any such errors and hereby disclaims all warranties and conditions, including all implied warranties and conditions of merchantability, fitness, title, completeness and non-infringement with regard to the aforementioned information. For the purposes of this clause, a reference to Football Fan shall also deem to include a reference to the affiliates, directors, officers, employees, consultants of Football Fan. Football Fan cannot guarantee that the information on this App is accurate, complete or up-to-date. While Football Fan intend to make every attempt to keep the information in this App current, the owners of and contributors to this App make no claims, promises or guarantees about the accuracy, completeness or adequacy of the information contained in this App.
To the fullest extent permitted by applicable law, in no event shall we be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use this web site or app or the content, or any failure of performance, error, omission, interruption, effect, delay or defect in operation or transmission, virus, line system failure, or loss of use related to this web site or app, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages. If you are dissatisfied with this app, or these terms of use, your sole and exclusive remedy is to discontinue your use of the app.
Football Fan does not warrant the accuracy, completeness, currency or non-infringement of the Information provided in the App hereunder; and (b) expressly disclaims all warranties and conditions, express, implied or statutory, including without limitation the implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement. While the Information has been obtained from sources believed to be reliable, neither Football Fan nor Football Fan’s content providers warrant the accuracy of the Information.
The use of the App is at the risk of the user. In no event shall Football Fan or any of its affiliates, directors, employees, officers, consultants, be liable for, directly or indirectly, any damages of any kind or nature, including without limitation, direct, indirect, incidental, consequential, or any claims or losses, whether foreseeable or not; or whether the User has been informed of the possibility in advance, resulting from or in connection with the creation or use of, or reliance in the App, any other third-party App, the links contained in any App or the inability to use the App. This limitation includes damage to your equipment or any viruses that may infect your equipment.
The interactive nature of postings on the App makes it impossible for Football Fan to assume responsibility for any of the materials posted by Users. The ideas, suggestions, opinions, comments, and observations made by Users, and any text, data, photographs, video, music, sound, chat, messages, files or other material provided by Users ("User Submissions") are not endorsed by Football Fan, and Football Fan makes no guarantee regarding the reliability, accuracy, or quality of any User Submission that is posted on the App.
User shall evaluate and bear any risks related to the use of any User Submission, including any reliance on the accuracy, completeness, or usefulness of such User Submission. All User Submissions posted to the App are the sole responsibility of the person who originally posted the User Submission, and Users' sole recourse for any damage, loss, claim, action or liability as a result of such User Submissions shall be against the individual User. Users shall be solely responsible for their own User Submissions and the consequences of posting or publishing them. Users shall retain all ownership rights in their respective User Submissions. However, by submitting the User Submissions on the App, Users hereby grant Football Fan a perpetual, worldwide, non-exclusive, royalty-free, sublicense-able, transferable right and license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the App and Football Fan's business, including without limitation for promoting and redistributing part or all of the App (and derivative works thereof) in any media now known or hereafter developed. The foregoing license granted by Users shall automatically terminate upon removal or deletion of the User Submission from the App.
If Users choose to post User Submissions on the App, User represent that such User Submission is in adherence to applicable laws, generally accepted rules of etiquette and standards of behavior. Users' use of the App shall reflect their respect for the legal rights of Users connected with Football Fan. Users understand that Football Fan does not guarantee any confidentiality with respect to any User Submission, and specifically release Football Fan from any liability whatsoever in this regard. Football Fan expressly disclaims any and all liability in connection with User Submissions. Football Fan reserves the right to remove Content and User Submissions in its sole discretion and without prior notice.
Football Fan also reserves the right to terminate a User's access to the App at any time, at its sole discretion and without prior notice. Football Fan or its directors, employees or agents, will not be responsible/ liable for any loss, damage, injury caused to a user arising out of use of the information on this App, including legal action arising out of negligence or other third-party action due to professional misconduct or omissions/acts of Service Providers. Also, Football Fan or its directors, employees or agents, will not be responsible/ liable for any loss or damage caused to a Service Provider as a result of any claim made by the User including any legal action arising out of professional misconduct or violation of applicable laws governing the profession of the Service provider. The provision relating to the absence of liability of Football Fan, survives the expiration or termination of these terms and use for any reason whatsoever. Football Fan disclaims any warranties express or implied connected with use of the information on the App including its quality, availability or accuracy.
Any communication or material that the user transmits or posts on the App by electronic mail or otherwise, including any data, questions, comments, suggestions (“User Information”), is and will be treated as non-confidential and non-proprietary information and shall become the property of Football Fan. Football Fan, or any its affiliates, may store or use the User Information for any purpose whatsoever, including but not limited to, reproduction, disclosure, transmission, publication, broadcast or further posting, without any compensation to the user. The user also expressly acknowledge that Football Fan, or any of its affiliates, are free to store, use any ideas, concepts, know-how or techniques contained in any User Information, for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products, without any compensation to the user. In case of a change in control of Football Fan, Football Fan reserves the right to transfer the User Information to the new party. Notwithstanding the above, the users are prohibited from altering the App or posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, profane material that could constitute or encourage conduct that would be considered a criminal offence, give rise to a civil liability or otherwise violate any law. Football Fan will cooperate with any law enforcement authorities or court order requesting or directing Football Fan to disclose the identity of anyone posting such information or materials. The user agrees to indemnify and hold Football Fan, its affiliates, directors, employees and consultants harmless from any claim, demand or damage, including reasonable attorney fees due to or arising out of the users conduct on Football Fan.
Upon a request by Football Fan, you agree to defend, indemnify and hold harmless Football Fan and its affiliates, directors, employees and consultants against any claims, demands, actions, damages or other liabilities, including expenses and attorney’s fees that arise from your use of this APP. Football Fan reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Football Fan in asserting any available defences.
This App is created and controlled by Football Fan; as such the laws of England and Wales shall apply; and courts in Surrey only shall have jurisdiction in respect of the Terms and Conditions. Football Fan reserves the right to unilaterally change the terms of use of the App and information without notice as may be required from time to time. Users are advised to read the terms for regular updates each time they visit the App. Football Fan reserves the right of deleting any information contained on the App without notice for any reason whatsoever.
If you become disgruntled with Football Fan for any reason, we’d like the opportunity to work out our differences informally. We strongly encourage you to contact us at support@footballfanapp.com, and we’ll do our best to resolve the dispute in good faith.
If we aren’t able to solve the problem that way, we both agree that we will resolve any claims arising from these Terms or the Football Fan service by final and binding arbitration. The arbitration will take place in Surrey, United Kingdom. Either of us may file a lawsuit in court solely for injunctive relief against the other to stop misuse of Football Fan or intellectual property infringement without first going through arbitration. You agree to resolve any dispute you have with us on an individual basis in arbitration, and not as a class arbitration, class action or consolidated proceeding of any kind.
Subject to your compliance with these Terms, Football Fan grants you a limited non-exclusive, non-transferable, non-sub licensable license to download and install a copy of the App on a mobile device or computer that you own or control and to run such copy of the App solely for your own personal non-commercial purposes. You may not copy the App, except for making a reasonable number of copies for backup or archival purposes. Except as expressly permitted in these Terms, you may not: (i) copy, modify or create derivative works based on the App; (ii) distribute, transfer, sublicense, lease, lend or rent the App to any third party; (iii) reverse engineer, decompile or disassemble the App; or (iv) make the functionality of the App available to multiple users through any means. Football Fan reserves all rights in and to the App not expressly granted to you under these Terms.
If you accessed or downloaded the App from the Apple Store, then you agree to use the App only: (i) on an Apple-branded product or device that runs iOS (Apple’s proprietary operating system software); and (ii) as permitted by the “Usage Rules” set forth in the Apple Store Terms of Use.
If you accessed or downloaded the App from any app store or distribution platform (like the Apple Store, Google Play or the Amazon App Store) (each, an “App Provider”), then you acknowledge and agree that:

We are not responsible for and will not have any liability for any damages or injuries of any kind arising in connection with the content of linked third party sites, sites framed within Our Apps, or third-party advertisements. We do not make any representations regarding the content or accuracy of third-party sites. Your use of third-party sites is at your own risk and subject to the terms and conditions of use for such sites. Football Fan or any of its affiliates, directors, employees and consultants make no claim, and are not responsible for, any information found in such third-party web sites.
We do not warrant that the App will be compatible or interoperable with your mobile device or any hardware, software, equipment or device installed on your mobile device or used by you to access and use the mobile application in connection with your mobile device (“Accessories”). You acknowledge that compatibility and interoperability problems: (a) may cause the performance of the App, your mobile device and any Accessories to diminish or fail completely; (b) may result in permanent damage to your mobile device and any Accessories; (c) may result in a loss of data on your mobile device or Accessories; or (d) may result in the corruption of software and files located on your mobile device and any Accessories. You acknowledge and agree that Football Fan shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.
You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password and login credentials secure. You may never use another person’s user Account or registration information for the Services without permission. You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You shall have the ability to delete your Account, you may do so by deleting the App and by emailing us at support@footballfanapp.com.
a. Definition. For purposes of these Terms of Use, the term "Content" includes, without limitation, information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Services. For the purposes of this Agreement, “Content” also includes all User Content (as defined below).
b. User Content. All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively "User Content"), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. You represent that all User Content provided by you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations. You retain ownership of any and all User Content created and/or uploaded by you. You acknowledge that all Content, including User Content, accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. We do not guarantee that any Content you access on or through the Services is or will continue to be accurate.
c. Content Aggregation. We act as a content aggregator from various third party sources to provide you with a wholesome experience on our platform which is duly and appropriately credited. For example, we use YouTube API services to integrate and share YouTube videos that can be watched on our platform and on social media feeds powered by us. d. Notices and Restrictions. The Services may contain Content specifically provided by us, our partners or our users and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Services.
e. Use License. Subject to these Terms of Use, we grant each user of the Services a worldwide, non-exclusive, non-sublicensable and non-transferable license to use (i.e., to download and display locally) Content solely for purposes of using the Services. Use, reproduction, modification, distribution or storage of any Content (other than your User Content) for other than purposes of using the Services is expressly prohibited without prior written permission from us. You shall not sell, license, rent, or otherwise use or exploit any Content (other than your User Content) for commercial use or in any way that violates any third party right.
f. License Grant. By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, manipulate, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content in connection with the App, the Services and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the App or the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds), and including after your termination of your Account or the Services. For the sake of clarity, to the extent any User Content you submit includes your name, likeness, voice, video, or photograph, you acknowledge and agree that the foregoing license of this Section 3(e) shall apply to the same. You also hereby do and shall grant each user of the App and/or the Services a non-exclusive, perpetual license to access your User Content through the App and/or the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Content, including after your termination of your Account or the Services. For clarity, the foregoing license granted to us and our users does not affect your other ownership or license rights in your User Content, including the right to grant additional licenses to your User Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third-party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.
g. Availability of Content. We do not guarantee that any Content will be made available on the App or through the Services. We reserve the right to, but do not have any obligation to, (i) remove, edit or modify or otherwise manipulate any Content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if we are concerned that you may have violated these Terms of Use), or for no reason at all and (ii) to remove or block any Content from the Services.
a. As a condition of use, you promise not to use the Services for any purpose that is prohibited by these Terms of Use. You are responsible for all of your activity in connection with the Services. Violation of our rules may result in the termination and cancellation of your Account and forfeiture of your FanCoins®. You acknowledge and agree that we may terminate any Football Fan Account at any time for any reason (including, but not limited to, our independent assessment or the receipt of claims or allegations from third parties or authorities).
b. By way of example, and not as a limitation, you shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content on or through the Service, including without limitation any User Content, that:
i. infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty, including but not limited to, facilitating the rebroadcast of the Football Fan Services (see our DMCA Copyright Policy below);
ii. uses the Services for any unauthorized purpose, or in violation of any applicable law, including intellectual property laws;
iii. uses screen reader technology, algorithms, or any other automated technological means to interpret, analyze, research, or gain information about a question or submit an answer to a question;
iv. you know is false, misleading, untruthful or inaccurate, including, but not limited to, providing inaccurate contact or Account information;
v. illicitly manufactures FanCoins® or other benefits by providing inaccurate information, buying or selling such benefits or other means;
vi. results in the sale or transfer of your Account;
vii. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, obscene, vulgar, pornographic, offensive, profane, contains or depicts nudity, contains or depicts sexual activity, otherwise violates any law or right of any third party, or is otherwise inappropriate as determined by us in our sole discretion;
viii. constitutes unauthorized or unsolicited advertising, junk or bulk email ("spamming");
ix. contains software viruses or any other computer codes, files, content, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party; is designed or intended to obtain password, Account, or private information from any Football Fan App user;
xi. impersonates any person or entity, including any of our employees, representatives, or users;
xii. promotes or links to affiliate programs, multi-level marketing schemes, sites repurposing existing stories or off-topic content; or
xiii. includes anyone’s identification documents or sensitive financial information.
c. You shall not: (i) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (iv) run any form of auto-responder or "spam" on the Services; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the App without our express written permission; (vi) harvest or scrape any Content from the Services; or (vii) otherwise take any action in violation of our guidelines and policies.
d. You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Services (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction, (ii) modify, translate, or otherwise create derivative works of any part of the Services, or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations.
e. You shall not use ”followership" feature in our App to display posts and hashtags: (i) from private social media accounts that are not owned by you without the specific permission of the owner of any such account; (ii) that infringe upon the proprietary rights of third parties, including without limitation intellectual property rights, or rights of publicity or privacy; or (iii) that violate any law, statute, ordinance or regulation.
f. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Use, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of us, our users and the public.
g. If for any reason the Service is not running as originally planned (e.g., if it becomes corrupted or does not allow the proper usage and processing of entries in accordance with the rules, or if infection by a computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes of any kind, in the sole opinion of Company corrupts or affects the administration, security, fairness, integrity or proper conduct of the Service), Company reserves the right, in its sole discretion, to disqualify any individual implicated in or relating to the cause and/or to cancel, terminate, extend, modify or suspend the Service, and select the winner(s) from all eligible entries. If such cancellation, termination, modification or suspension occurs, notification may be posted on the Site.
In-App Purchases. Through the Applications, you may purchase ("In App Purchase") certain goods designed to enhance the performance of the Services (“Goods”). When you purchase Goods, you are doing so through either Apple iTunes service or the Google Play service and you are agreeing to their respective Terms and Conditions. (http://www.apple.com/legal/internet-services/itunes/us/terms.html; http://play.google.com/intl/en_us/about/play-terms.html). We are not a party to any In App Purchase.
Termination. We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your use of the Services. If you wish to terminate your Account, you may do so by deleting the App and by emailing us at support@footballfanapp.com. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
a. We have no special relationship with or fiduciary duty to you. You acknowledge that we have no duty to take any action regarding:
i. which users gain access to the Services;
ii. what Content you access via the Services; or
iii. how you may interpret or use the Content.
b. You release us from all liability for you having acquired or not acquired Content through the Services. We make no representations concerning any Content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, or legality of material or Content contained in or accessed through the Services.
c. The views and opinions of our hosts are their own and not necessarily representative of the views and opinions of the Company or its employees, and the Company assumes no responsibility for the Content, accuracy, or views of or opinions expressed by such hosts.
d. The services and content are provided "as is", “as available” and without warranty of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed. We, and our directors, employees, agents, suppliers, partners and content providers do not warrant that: (i) the services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the services is free of viruses or other harmful components; or (iv) the results of using the services will meet your requirements. Your use of the services is solely at your own risk.
Changes to Terms of Use (Modification). We reserve the right, in our sole discretion, to modify or replace any of these Terms of Use, or change, suspend, or discontinue the Services (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the App or by sending you notice through the Services, via email or by another appropriate means of electronic communication. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. While we will timely provide notice of modifications, it is also your responsibility to check these Terms of Use periodically for changes. Your continued use of the Services following notification of any changes to these Terms of Use constitutes acceptance of those changes, which will apply to your continued use of the Services going forward. Your use of the Services is subject to the Terms of Use in effect at the time of such use. We reserve the right to make additions, deletions, or modifications to these Terms of Use at any time without prior notification. If any provision of this Terms and Conditions is held by a court of competent jurisdiction to be unlawful, invalid, void or unenforceable, you agree that the provision will be enforced to the maximum extent permissible and the remaining provisions contained in this Agreement shall continue in full force and effect.
